ICE arrests Pittsfield man outside downtown Burger King

PITTSFIELD — Federal authorities confirmed that a Pittsfield resident was arrested Tuesday by U.S. Immigration and Customs Enforcement, as video footage depicted a chaotic arrest near the Wendell Avenue Extension.

The Department of Homeland Security identified the man Wednesday as Darwin Andres Gordon-Ruiz, 20. He is a 2025 graduate of Pittsfield High School.

On Tuesday, grainy footage showing agents restraining someone on the ground in the Burger King parking lot began circulating on social media. The video has apparently since been deleted.

Fernando León, a community organizer for Berkshire Interfaith Organizing who tracks ICE enforcement actions in Berkshire County, said he received four calls from people who witnessed the arrest, describing them as in a “total panic.” He said witnesses described the scene as “violent, chaotic and traumatizing.”

Court documents show Gordon-Ruiz filed a petition for a writ of habeas corpus on Tuesday following his arrest. Federal records show he's currently being held at the Plymouth County Correctional Facility.

The details of Gordon-Ruiz’s immigration history are not immediately clear. A DHS spokesperson said he is originally from Colombia and was living in the country illegally. His arrest comes amid a broader increase in immigration enforcement activity nationwide and follows at least one other publicly known ICE detention in Pittsfield in recent weeks.

“All of his claims will be heard before an immigration judge and he will receive full due process,” the DHS spokesperson said in a statement.

Gordon-Ruiz is currently facing charges in Berkshire County Superior Court, including two counts of rape and one charge of providing alcohol to a minor. He pleaded not guilty after his arrest in early November on an outstanding warrant. His bail was later set at $20,000.

He had been scheduled to appear at a status conference related to his charges the day of his arrest, court records show.

Pittsfield Mayor Peter Marchetti told The Eagle that ICE had contacted the Pittsfield Police Department on Tuesday afternoon to alert local authorities that they were in the area and “looking for someone specific.” He said the city did not assist ICE.

Sergeant Shaun Reagan confirmed Wednesday he had been contacted by ICE on Tuesday afternoon.

“They did call to let us know they were going to be in the city,” he said. “They did not ask for help” and “they didn’t name a specific individual” they were looking for, he added. He said he did not have further information.

After the arrest, León said “the question is not simply who was detained, but how these operations are conducted, whether agents properly identify themselves, and what responsibility public institutions have to provide clarity to the community afterward.”

The arrest is the second known ICE enforcement action recently. On April 22, ICE detained Temirlan Aldiyarov, a Dottie’s Coffee Lounge employee, in a “targeted enforcement operation.”

Raymond Jacoub, Gordon-Ruiz’s criminal defense attorney, declined to comment on either his client’s ICE arrest or his pending charges. Generally, he said ICE detentions can impede ongoing criminal proceedings, disrupt families and introduce financial hardship.

“The fact that ICE is trying to pick people up before they're even convicted, it’s counterproductive,” he said.

Berkshire District Attorney Timothy Shugrue has previously said that his office does not assist ICE, and his office has criticized the agency for arresting people with pending criminal cases, citing the need to make sure "justice is preserved for all parties" during the court process.

Jacoub also said he had recently been in touch with Gordon-Ruiz’s family.

“His mom and dad are very concerned,” he said. “They have a close relationship with their son. They were living together in Pittsfield and they're beyond distressed.”
